If your will says “to my issue per stirpes,” your estate is divided by family branch. Each of your children is allocated an equal share. If one of your children has already passed away, that child’s share goes to their own children (your grandchildren) and is divided equally among them. This approach keeps each child’s family line treated equally. If your will says “to my issue per capita,” your estate is divided equally among the individuals who qualify to inherit at the time of distribution. It does not preserve family branches. Instead, everyone in the qualifying group (i.e., Children) shares equally as individuals.
